In Balkhash, a decision preventing a person with a disability from driving was successfully reconsidered. Following complaints, the previous refusal was overturned and a new expert approved driving. Behind that medical conclusion is something very practical: the ability to live more independently.
What was the dispute about?
Zhan Botanov knows from personal experience how difficult it can be to challenge a medical commission. Saying “the decision is wrong” is only a starting point. The work requires identifying its basis, obtaining the documents and addressing specific conclusions.
This case concerned a category B vehicle with an automatic transmission. The challenge covered a medical consultative commission (VKK) protocol dated 11 August 2026 and a subsequent response from the medical organisation. The central question was why the person’s ability to drive had been assessed without sufficient attention to the individual circumstances.
What did the complaints request?
Zhan Botanov helped formulate requests that could be checked against the records:
- Clarify the grounds for the original refusal.
- Provide the commission’s documents and the reasons for its decision.
- Assess the person’s actual functional abilities, the vehicle’s characteristics and possible adaptations.
- Carry out a new review with an independent expert assessment.
The position was that a relative contraindication should not become an absolute prohibition without sufficient justification. The safety of the driver and other road users remained the primary consideration.
The outcome changed
The previous refusal was overturned. A new expert authorised driving. This was the objective: a fresh assessment of the individual situation instead of a formal refusal.
A car can mean being able to attend medical appointments independently, work and manage everyday tasks. That is why a case like this matters beyond the exchange of letters with institutions.
