You do not need to memorise every code to protect your rights. It is more useful to know where to look for an answer to a specific question. These documents are starting points for disputes about social support, employment, healthcare and accessibility.
1. The Social Code: support and rehabilitation
The Social Code of Kazakhstan is a central reference for social protection. Start with Article 154 on the rights of persons with disabilities, Article 155 on medical and social assessment, and the provisions on rehabilitation and the Social Services Portal. Article 177 sets out state benefit rates for different categories.
Check the cause of disability and the conditions attached to each measure. A statement that “everyone is entitled” is not enough without the relevant provision. Do not rely on an older standalone disability protection law without checking its legal status and period of application.
2. The assessment rules: group, duration and appeals
Order No. 260 of 29 June 2023 regulates medical and social assessment (MSE). It covers referrals, group criteria, duration of status and complaints. Paragraph 31 and Annex 7-1 are particularly relevant to indefinite status; Annex 7-2 concerns a five-year period.
Read each entry in full. A disease name without the associated severity requirements can create a misleading impression of automatic entitlement. Compare the exact rule with the medical evidence.
3. The Health Code: patient rights
The Code on Public Health and the Healthcare System covers medical care, health information, consent and confidentiality. In a clinic dispute, first identify the issue: refusal of care, withheld information or a referral problem.
4. The Labour Code: workplace guarantees
Check Articles 69 and 89 of the Labour Code. They provide a reduced working week and additional paid leave for employees with Group I or II disability. These provisions should not automatically be extended to Group III. Employment contract terms and medical recommendations also matter.
5. Administrative procedures and judicial protection
The Administrative Procedure and Process Code regulates administrative procedures and court protection in relevant disputes. It helps distinguish an information request from an appeal against a decision. Check the pretrial procedure, administrative complaint deadline and court deadline separately: there is no single deadline covering all correspondence.
6. The UN Convention on the Rights of Persons with Disabilities
Kazakhstan ratified the Convention on the Rights of Persons with Disabilities. It addresses equality, independence, accessibility and participation. Article 9 concerns accessibility; Article 27 concerns work and employment. In a specific complaint, connect these principles with national legislation and the actual infringement.
7. Legal assistance and personal data
The law on advocacy and qualified legal assistance explains forms of assistance and statutory eligibility conditions. Free representation should not be promised solely on the basis of disability: the person’s category and the nature of the issue matter.
The law on personal data and its protection matters when sharing medical records, publishing a personal account or questioning an organisation’s use of information. A public post normally does not need an individual identification number, home address or an unredacted medical record.
How to use a legal text
Check the document’s status, the effective date of the relevant version and the notes to the article. A published amendment may not yet be in force. Then identify three things: your right, the recipient’s duty and the supporting fact. Together, these form a clear request.
